Criminal Defense & Bail

What is the difference between pre-arrest bail (Section 498) and post-arrest bail (Section 497 CrPC)?

In Pakistan criminal jurisprudence, Pre-Arrest Bail (Section 498 CrPC) is sought before the police arrest the accused. The applicant must demonstrate genuine apprehension of imminent arrest and demonstrate that the case involves mala fide (malice), ulterior motives, or police harassment. Post-Arrest Bail (Section 497 CrPC) is petitioned after the accused has been arrested and placed in judicial remand. For offences outside the prohibitory clause (punishable by less than 10 years imprisonment), bail is granted as a matter of right under the landmark Supreme Court ruling in Tariq Bashir v. State.

Criminal Defense & Bail

An FIR has been registered against me in Islamabad or Rawalpindi. What should I do immediately?

Do not panic and do not attend the police station without qualified legal representation. First, obtain a certified copy of the FIR through your advocate. Second, file an urgent application for ad-interim pre-arrest bail before the Sessions Court or Islamabad High Court to obtain immediate protection from arrest. Once protective or interim bail is granted, you will formally join the police investigation (Tafteesh) accompanied by your advocate.

Criminal Defense & Bail

How are surety bonds (Zamanat-nama) verified at the court Nazarat branch?

After the court orders bail, it requires one or two solvent sureties of a specified amount (e.g., PKR 100,000 to PKR 500,000). The surety must appear in person before the court with their original CNIC and documented proof of solvent property (such as original Fard Malkiat, registered property deed, or vehicle registration book). The court Nazir examines the documents for encumbrances. Once verified, the Magistrate or Sessions Judge signs the Robkar (release order) dispatched to Central Jail Adiala or the police station.

Criminal Defense & Bail

When can a false FIR be quashed directly by the Islamabad High Court under Section 561-A CrPC?

Under Section 561-A of the Criminal Procedure Code, the High Court exercises inherent powers to prevent abuse of the process of any court. An FIR can be quashed if: (1) the allegations on the face of the record disclose a purely civil dispute without any criminal mens rea, (2) the case was initiated out of proven political or personal vendetta with no corroborating evidence, or (3) no cognizable offence is disclosed even if all statements in the FIR are taken as true.

Family Law & Khula

How long does it take to obtain a Khula decree under the Family Courts Act 1964?

Under the amended Family Courts Act 1964 and the landmark Supreme Court ruling in Mst. Khurshid Bibi v. Baboo Muhammad Amin, a wife is entitled to Khula as a matter of right if she cannot live with her husband within the limits prescribed by Allah. Under Section 10(4), if the husband refuses reconciliation during the pre-trial stage, the Family Court is legally mandated to pass an immediate decree for dissolution of marriage without prolonging the trial. Typically, an uncontested Khula decree takes 2 to 4 weeks in Islamabad and Rawalpindi.

Family Law & Khula

Does a wife have to return her Haq Mehr (dower) or bridal jewelry when seeking Khula?

Under Section 10(4) of the Family Courts Act, if the dower (Mehr) was non-deferred and paid at the time of marriage, the court usually directs the surrender of up to 25% or 50% of the prompt dower depending on the circumstances, while deferred dower is waived. However, personal gifts, dowry articles (Jahez), and jewelry owned by the wife remain her absolute property and are fully recoverable through a separate or consolidated claim for recovery of dowry articles.

Family Law & Khula

Who gets custody of minor children (Hizanat), and how does the Guardian Court decide?

Under the Guardians and Wards Act 1890, the paramount and sole consideration for custody is the "welfare of the minor" (welfare of child doctrine). Under Islamic jurisprudence, mothers have the right of Hizanat (physical custody) during tender years (generally up to 7 years for boys and puberty for girls), while fathers remain natural guardians responsible for financial maintenance. A mother does not automatically lose custody simply because she earns less, remarries, or lives in a different city, provided the childs emotional, educational, and physical welfare is best served in her care.

Family Law & Khula

How do I obtain an official NADRA Divorce Certificate after getting a court decree?

A Family Court Khula decree alone does not automatically update NADRA records. Under Section 7 of the Muslim Family Laws Ordinance 1961, the decree must be submitted to the Chairman of the concerned Union Council or Arbitration Council. The Union Council issues three successive reconciliation notices over 90 days. Upon the expiry of 90 days without reconciliation, the Union Council issues the official Divorce Effectiveness Certificate, which is then submitted to NADRA to update marital status on CNIC and passport.

Corporate & SECP

How long does company registration take with the SECP, and what is required?

Incorporating a Private Limited Company (Pvt Ltd) or Single Member Company (SMC) via SECPs eZfile digital portal typically takes 3 to 7 working days once names and documentation are approved. Requirements include: (1) 3 unique proposed company names, (2) CNIC/NICOP copies and mobile numbers registered in promoters CNICs, (3) registered office address in Pakistan, (4) Memorandum of Association (MoA) and Articles of Association (AoA), and (5) declaration of authorized share capital.

Corporate & SECP

What is the structural difference between a Pvt Ltd, SMC, and LLP in Pakistan?

A Private Limited Company (Pvt Ltd) requires a minimum of two directors/shareholders and offers separate legal personality with limited liability. A Single Member Company (SMC-Pvt Ltd) permits an individual entrepreneur to enjoy corporate limited liability as sole director and shareholder. A Limited Liability Partnership (LLP) combines the tax pass-through structure and flexibility of a traditional partnership with limited liability protection under the Limited Liability Partnership Act 2017.

Corporate & SECP

What post-incorporation tax registrations are legally required with the FBR?

Immediately after receiving the SECP Certificate of Incorporation, the entity must: (1) apply for a Corporate National Tax Number (NTN) on FBR Iris, (2) register for Sales Tax (STRN) if manufacturing, importing, or trading taxable goods, (3) register with the relevant provincial revenue board (PRA in Punjab, SRB in Sindh) if providing services, and (4) open a dedicated corporate bank account verified with SECP Form 29.

Corporate & SECP

How do I protect my brand name and logo with IPO Pakistan?

Trademark protection is secured under the Trade Marks Ordinance 2001 through the Intellectual Property Organization (IPO) of Pakistan. The process involves: (1) Comprehensive trademark search across relevant Nice Classes, (2) filing Form TM-1 with representation of the mark, (3) examination and issuance of an official examination report, (4) publication in the Trade Marks Journal for public opposition (2 months), and (5) issuance of the Trademark Registration Certificate valid for 10 years and renewable indefinitely.

Property & Real Estate

How do I verify clear land title and avoid illegal housing schemes in Islamabad?

Before paying any token money or signing an agreement, verify: (1) Whether the housing society has an approved layout plan (LOP) and No Objection Certificate (NOC) from the Capital Development Authority (CDA) or Rawalpindi Development Authority (RDA), (2) The original chain of title at the Sub-Registrar / Tehsildar office, ensuring no lis pendens (pending litigation) or mortgages are recorded, and (3) In CDA sectors, obtain an official Transfer Verification Letter directly from the CDA One Window Directorate.

Property & Real Estate

What immediate legal action can be taken against illegal land grabbing or encroachment?

Under Pakistani law, victims of land grabbing have both civil and criminal remedies. Under the Illegal Dispossession Act 2005, a direct complaint can be filed before the Court of Session, where the court has power to restore possession and penalize the grabber with up to 10 years imprisonment. In addition, an urgent civil suit for recovery of possession under Section 9 of the Specific Relief Act 1877 or Order 39 of the CPC for an ad-interim prohibitory injunction can be filed to prevent construction or third-party transfer.

Property & Real Estate

How quickly can I secure a stay order (temporary injunction) under Order 39 CPC?

An urgent civil suit accompanied by an application for ad-interim injunction under Order 39, Rules 1 and 2 of the Code of Civil Procedure (CPC) can be placed before the Civil Judge or High Court within 24 to 48 hours. The court evaluates three mandatory tests: (1) A prima facie arguable case, (2) Balance of convenience in favor of the applicant, and (3) Irreparable loss or injury that cannot be compensated with money if the stay is denied.

Overseas Pakistanis

Can an Overseas Pakistani litigate or defend a court case in Pakistan without traveling?

Yes. Overseas Pakistanis in the UK, USA, Canada, UAE, Saudi Arabia, and Europe can appoint a trusted relative or their advocate through a Special Power of Attorney (Mukhtar-nama Khas). Once attested by the Pakistan High Commission or Consulate and counter-verified at the Ministry of Foreign Affairs (MOFA) in Pakistan, our advocates appear in court, file pleadings, conduct cross-examinations, and manage hearings while keeping the overseas client briefed via video calls and secure digital filings.

Overseas Pakistanis

What is the procedure for executing a Power of Attorney abroad?

The principal abroad executes the Power of Attorney before the Consular Officer at the Pakistan Embassy/Consulate or digitally through NADRAs Online Power of Attorney portal (for eligible jurisdictions). Once signed and attested, the document is couriered to Pakistan, where the agent/advocate gets it registered with the Foreign Office (MOFA Islamabad or regional office) and stamped at the local District Collector / Sub-Registrars office. It is then legally recognized across all Pakistani courts and land revenue offices.

Overseas Pakistanis

How can Overseas Pakistanis safeguard ancestral inherited property from fraudulent transfer?

We conduct title audits at the local Land Revenue Office (Patwari/Tehsildar), record cautionary notices (Indraaj) in the revenue record against unauthorized mutations (Intiqal), and obtain certified copies of the Record of Rights (Jamabandi). If foul play is suspected, we file an immediate suit for declaration with a temporary injunction before the Civil Court to freeze any third-party alienation.

Civil & High Court

When can a Constitutional Writ Petition under Article 199 be filed before the Islamabad High Court?

Article 199 of the Constitution of Pakistan empowers the High Court to issue prerogative writs (Mandamus, Prohibition, Certiorari, Quo Warranto, Habeas Corpus) against state functionaries, government ministries, CDA, police, and statutory regulators when: (1) fundamental constitutional rights are violated, (2) an authority has acted without lawful authority or in excess of jurisdiction, and (3) there is no other adequate, speedy, and efficacious remedy provided by law.

Civil & High Court

What is the purpose and legal significance of issuing a formal Legal Notice?

A formal Legal Notice drafted by a High Court advocate places the opposing party on formal record, articulates cause of action, sets a statutory compliance deadline (typically 7 to 14 days), and preserves the right to claim legal costs and damages. In commercial contract disputes, defamation matters under the Defamation Ordinance 2002, and cheque dishonor cases under Section 489-F PPC, a legal notice is either legally mandatory or highly persuasive evidence before filing suit.
